1. Introduction
These Terms of Service ("Terms") govern your use of Agendara, a time management web application operated by 10ideen.at ("we", "us", "our"). By creating an account or using our service, you agree to be bound by these Terms. If you do not agree, please do not use Agendara.
2. Eligibility
You must be at least 16 years of age to use Agendara, in accordance with the General Data Protection Regulation (GDPR). By creating an account, you confirm that you meet this age requirement.
3. Account Registration
When you register for an account, you agree to provide accurate and complete information. You are responsible for maintaining the security of your account credentials, including your password. Each person may only maintain one account. You must notify us immediately if you suspect unauthorized access to your account.
4. Service Description
Agendara is a personal time management application that provides task management, effort-based auto-scheduling, external calendar synchronization, and iCal feed functionality. The service is provided on an "as is" and best-effort basis.
5. Beta Service
Agendara is currently offered as a beta service. This means that the service may be discontinued at any time without prior notice. Features may change, be added, or be removed without warning. Pricing may be introduced in the future. While we take reasonable care to protect your data, data loss may occur during the beta period.
6. Availability and Reliability
We do not guarantee any specific level of uptime or availability. There is no service level agreement (SLA). The service may be interrupted at any time for maintenance, updates, or other reasons without prior notice. We will make reasonable efforts to minimize disruptions but accept no liability for downtime.
7. Data and Privacy
Your use of Agendara is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. You retain ownership of all content you create within Agendara. You may export your data or delete your account at any time from your account settings.
8. Calendar Integration
By connecting an external calendar (such as Google Calendar or Apple Calendar), you authorize Agendara to access your calendar data for the purpose of availability calculation and scheduling. The iCal feed feature provides a URL containing a secret token that grants read-only access to your scheduled task slots. It is your responsibility to keep this URL confidential. You can regenerate or disable your feed token at any time from your account settings.
9. AI Features
Agendara offers optional AI-powered features, including step suggestions. When you use these features, your task title and description are sent to OpenAI's API for processing. AI-generated suggestions are provided for informational purposes only and do not constitute professional advice. You are responsible for reviewing and approving all AI-generated content before it is applied.
10. Intellectual Property
All rights in the Agendara service and software, including its design, code, and branding, are owned by 10ideen.at. You retain full ownership of any content you create within the service, including tasks, projects, steps, and descriptions.
11. Limitation of Liability
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by Austrian law, 10ideen.at shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of or inability to use the service.
12. Termination
You may delete your account at any time from your account settings. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
13. Changes to Terms
We may update these Terms at any time. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will notify you via the email address associated with your account.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Austria. Any disputes arising from or relating to these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in Austria.
